I  a court of law, if the "other" documenst are not filed, they do not
exist. Judges/jury can only make decisions based on evidence that was
filed in the proceeding.

If HP chooses to not file documents that show Oracle is wrong, then the
judge has to accept the ORacle documents as truth because they were not
challenged.  (And chances are that HP can't prove the Oracle documents
are wrong because they are likely true).
