Self driving cars will come and the legal liability issue will be solved by forcing drivers who do not engage or use self driving technology off the roads through premium costs
The same as house insurance where you need to have certain locks attached on doors as well as windows in order to not be hit with excessive premiums, so car insurance will go down the same route
As cars get smarter they will interface more to the structures around them. The real safety in self driving cars will come from their ability to integrate with other vehicles around them and coordinate for safety outcomes, after all, synergy is the fact that the sum is greater than the parts. Individual self driving cars is one thing, a fleet of them working together is quite another and it's in this capacity that they will eclipse human beings abilities for the vast majority of driving conditions
Eventually, a human driver going it alone without all the technology that can take into account 1000's of relevant items in a fraction of a second and coordinating intelligently with vehicles around them will be seen as a liability to insurance companies and either not insured or priced out of the market
Already on automated factory floors robots have free reign in the majority of the factory and humans are confined to certain sections lest they stumble into the real productive areas and get hurt by their metal overlords
I suspect what will eventually happen is that the human owner will be forced to take legal responsibility of the self driving cars and that insurance companies will demand that humans use the features to reduce risk or pay a huge premium, thus the self driving car manufacturers will sidestep the legal issues almost entirely and that they'll only become in the cross hairs when something goes rougue and the poor driver is forced to take action against them and then your back to a David vs Goliath legal fight, like it is now
