Ok, let me see if I understand this.

Case 1: No system to use, therefore no data to be stolen.

Case 2: Use the system, and perhaps, just perhaps, there might be some nefarious 
activity.

Case 1 is absolute, case 2 is a maybe.  Both bad, but, I'm not so sure you have 
correctly identified the worst case.
