Another point is that, if they bundle their ZFS code with Linux, then the 
recipients are entitled to accept it under the terms of the GPL, which 
allows them to redistribute it to others under the same terms, and that 
would be the effective end of the CDDL.

Sure. We are aware of the legal maneouvring behind the scenes. But the 
immediate optics of it, intended or not, is that they are reluctant to 
give a vote of confidence in their own technology, instead favouring a 
different open-source rival.

That has got to be a source of corporate embarrassment.
