Yes but the carpenter should not have used a power saw without a blade 
guard.  You may remove or disable blade guards for your convenience but 
if you do you deserve whatever happens to you.

If a power saw without a blade guard is in use OSHA may have a few words 
to say on the subject here in the U.S. and may levy a substantial fine 
if this occurs in the workplace.

If you use a power saw at home and remove or defeat the blade guard the 
only penalty is the injury that will happen sooner or later.
